My gut feel from years of experience is they are playing a fast one, the SPI flash would need to be driven also from that regulator, and I sure its not.

Why 5? Why not 100? Or 1000? The main point of the power supply regulation requirement is so that you can't overdrive the RF amplifier and boost the transmit power.
